Night work in Brazil
For urban CLT workers, work between 10 pm and 5 am is night work. The law gives two advantages:
- A premium of at least 20% on the hourly rate.
- A shorter night hour of 52 minutes and 30 seconds, so 7 clock hours count as 8 paid hours.
Worked example
Salary R$ 2,200 with a 220-hour divisor: R$ 10 an hour. In the month the employee worked 70 clock hours at night, which count as 70 × 60 ÷ 52.5 = 80 hours. The premium is 80 × R$ 10 × 20% = R$ 160.
Good to know
Collective agreements often set a higher premium; enter it in the percentage field. Rural workers have different hours and a 25% premium without the reduced hour. The night premium counts as pay for INSS, income tax, FGTS, vacation and the 13th salary.
